Terms of Use

The Services are intended for residents of Switzerland and the member states of the European Union and the European Economic Area (including the Principality of Liechtenstein). You must be at least sixteen (16) years old to create an account and use the Services. If you do not agree, please stop using the Services and ask us to close any account you have created.

If you reside in the European Union or the European Economic Area, you have the right to withdraw from this agreement within fourteen (14) days of creating your account, without giving any reason. To exercise this right, send us a clear statement to support@fidloop.com or simply close your account in the App settings. As the Services are provided free of charge, withdrawal has no cost and simply ends the agreement; points and offers accrued until then expire with the account.

You are responsible for the device, software and connectivity you need to use the Services, including any mobile data charges. We do not guarantee that the Services work on every device or operating system. You may use the Services only on a device you own or control, and only with a supported operating system.

You may hold only one FidLoop account. You are responsible for keeping your login credentials secure and for everything that happens under your account. Keep your account information accurate and up to date and tell us promptly of any unauthorised use.

FidLoop grants you a personal, non-exclusive, non-transferable and revocable right to use the Services for your own private, non-commercial purposes. You may not:

• reverse engineer, decompile or attempt to derive the source code of the App;
• use scrapers, bots or automated tools to access or interact with the Services;
• manipulate point balances, duplicate QR codes, submit fraudulent receipts or otherwise abuse the Services;
• use the Services in breach of Swiss, EU or other applicable law.

FidLoop is a technology platform. The restaurants and other merchants that you see in the App are independent businesses. Each merchant runs its own loyalty program, sets its own rewards and offers, and is solely responsible for the products and services it provides to you and for complying with applicable laws. A purchase you make at a participating restaurant is a contract between you and that restaurant, not with FidLoop.

We may from time to time update, modify or withdraw all or part of the Services, including by distributing updates to or removing features from the App on your device. We will normally give reasonable notice for changes that materially affect you, but we may act without notice where required for security, legal or operational reasons.

We may update these Terms for valid reasons, such as changes in the law, new or changed features, security requirements, or changes to our business model. If a change materially affects your rights or obligations, we will notify you in the App and by email at least thirty (30) days before it takes effect. If you do not accept a material change, you may close your account free of charge before the change takes effect; in that case you may redeem your outstanding points and offers during the notice period. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

These Terms are concluded between you and FidLoop only, not with Apple Inc. or Google LLC. FidLoop, not Apple or Google, is solely responsible for the App and for any claim relating to it. Apple and Google have no obligation to provide maintenance or support for the App.

If you obtained the App from the Apple App Store, you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them directly against you.

We provide the Services with reasonable skill and care. We do not guarantee that the Services will be uninterrupted or error-free. If you reside in the European Union or the European Economic Area, your statutory conformity rights for digital services remain unaffected by these Terms.

Because merchants run their own loyalty programs, FidLoop is not liable for the quality of food, drink, service or rewards provided by a merchant, nor for a merchant's failure to honour a reward, changes to a merchant's point structure, or a merchant's closure.

Except in cases of gross negligence or wilful misconduct on our part, and subject to any liability that cannot be excluded under Swiss law, our total cumulative liability arising out of or relating to your use of the Services is limited to one hundred Swiss francs (CHF 100).

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any liability under mandatory product-liability law or other provisions that cannot be excluded by agreement.

You may close your account at any time from the App settings or by writing to us at the address below. Once closure is confirmed, any loyalty cards, points and offers held in your account expire immediately and cannot be reimbursed.

Deleting the App from your device does not close your account. You can close your account at any time in the App settings or at fidloop.com/delete-account. Your statutory data-protection rights (including the rights of access and erasure) are described in our Privacy Policy and apply independently of account closure.

We may suspend or close your account if you breach these Terms, if we reasonably suspect fraudulent or abusive activity, or if we are required to do so by law. We will tell you the reason unless prevented by law or by an investigation.

These Terms are governed by Swiss substantive law. If you reside in a member state of the European Union or the European Economic Area, you additionally benefit from the mandatory consumer-protection provisions of the law of your country of residence, and you may bring proceedings before the courts of your place of domicile. For all other users, the place of jurisdiction is Baar, Switzerland.

These Terms are available in English, French, German and Italian. In the event of discrepancies between the language versions, the English version prevails, except where mandatory law in your country of residence provides otherwise.
